Kinetic Consultancy Services LLC OPC (“Kinetic,” “Macky,” “we,” “our,” or “us”), a company registered in Dubai, United Arab Emirates, respects your privacy and is committed to protecting the personal information we collect from or about you. This Privacy Policy describes our practices with respect to personal information collected when you use macky.ai and related applications (collectively, the “Services”).
This Privacy Policy should be read together with our Terms of Service.
1. Personal Information We Collect
Information You Provide
- Account Information. When you create a Workspace account, we collect your name, email address, account credentials, and organization details.
- User Content. When you use the Services, we collect the information you submit, including chat prompts and messages to Ask Macky, files you upload for analysis, and information you provide when purchasing or completing intake for an Engagement (collectively, “User Content”).
- Payment Information. When you subscribe to a paid plan or purchase an Engagement, our payment processor (currently Stripe) collects your payment card details directly. We do not store your full card number; we retain limited billing information such as plan, amount, and payment status.
- Communication Information. If you contact us, we collect your name, contact details, and the contents of your message.
Information We Collect Automatically
- Log Data. Standard technical information your browser or device sends automatically, such as IP address, browser type, and request timestamps.
- Usage Data. Information about how you interact with the Services, such as features used and pages visited.
- Device Information. Device type, operating system, and browser information.
- Cookies. We use a single strictly-necessary session cookie to keep you signed in. We do not currently use analytics, advertising, or other tracking cookies.
2. How We Use Personal Information
We use personal information to:
- Provide and maintain the Services, including generating AI Outputs, delivering Engagements, and processing Consultant review and sign-off;
- Process payments and manage your subscription or Engagement purchases;
- Communicate with you about your account, purchases, and support requests;
- Improve and develop the Services;
- Detect, prevent, and address fraud, abuse, or security issues;
- Comply with our legal obligations and enforce our Terms of Service.
3. How AI Processing Works
When you use Ask Macky or purchase an Engagement, your prompts, uploaded files, and intake information are processed by AI systems to generate Outputs and draft Deliverables, and may be reviewed by a Consultant as part of our quality process. Our current AI model provider is Anthropic. Under Anthropic’s standard commercial terms, content submitted through their API is not used to train their models.
AI-generated Outputs may be inaccurate or incomplete — see Section 7 of our Terms of Service for more detail on the limitations of AI-generated content.
4. Aggregated and De-Identified Information
We may aggregate or de-identify personal information so it can no longer identify you, and use it to analyze and improve the Services. We will not attempt to re-identify such information unless required by law.
5. Disclosure of Personal Information
We may share personal information with:
- Service Providers. Vendors who help us operate the Services, including our payment processor (currently Stripe), AI model provider (currently Anthropic), and cloud hosting and infrastructure providers (currently DigitalOcean). These providers may only use personal information to perform services on our behalf.
- Business Transfers. If we are involved in a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of that transaction.
- Legal Requirements. We may disclose personal information if required by law, to protect our rights or property, to investigate fraud or security issues, or to protect the safety of our users or the public.
- Affiliates. We may share personal information with our affiliates, who will handle it consistently with this Privacy Policy.
We do not sell personal information.
6. Your Rights
Depending on where you are located, you may have rights to:
- Access the personal information we hold about you;
- Correct or update inaccurate information;
- Delete your personal information;
- Receive a copy of your personal information in a portable format;
- Restrict or object to certain processing;
- Withdraw consent, where we rely on consent as our legal basis;
- Lodge a complaint with your local data protection authority.
You can exercise many of these rights directly through your Workspace account settings. For other requests, contact us at [email protected].
We may need to verify your identity before completing a request, and may decline a request where permitted by law (for example, if we cannot verify your identity or the request is manifestly unfounded).
7. Children’s Privacy
The Services are intended for business use and are not directed to individuals under 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us at [email protected] and we will investigate and delete it if appropriate.
8. Links to Other Websites
The Services may link to third-party websites not operated by us. This Privacy Policy does not apply to those sites, and we encourage you to review their privacy policies separately.
9. Security and Retention
We use reasonable technical, administrative, and organizational measures to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
We retain personal information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected.
10. International Users and Data Transfers
Our servers and infrastructure are located in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
For users in the EEA, UK, or Switzerland, where required we rely on appropriate safeguards (such as standard contractual clauses) for transferring personal information outside those regions. Contact us at [email protected] for more information about the safeguards in place.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page and, for material changes, provide additional notice as appropriate.
